Rancho Cucamonga Domestic Violence Attorney Who Knows the Stakes

A domestic violence arrest can upend your life. A protective order may keep you out of your home and away from your kids, and a conviction can cost you your gun rights, your job, license or clearance, and, for non-citizens, immigration status.

In California, domestic violence is a group of charges defined by your relationship with the other person, such as a spouse, dating partner, cohabitant, or co-parent. Police often arrest on the spot, even if nobody wants to press charges.

Sheriff’s deputies staff the Rancho Cucamonga Police Department, and booking is typically at West Valley Detention Center. Adult cases from Rancho Cucamonga, Alta Loma, Etiwanda, Upland, Ontario, Montclair, Chino and Chino Hills go to the Rancho Cucamonga Courthouse, 8303 Haven Avenue, where the San Bernardino County District Attorney’s Office prosecutes them. Any civil restraining order case runs separately in family court.

Misdemeanor Domestic Violence

  • Violating a Protective Order: Up to one year in county jail and a $1,000 fine. Repeat violations involving violence can be felonies.

Most of these charges are “wobblers,” filed as misdemeanors or felonies depending on the injury, any weapon, and your record.

  • Corporal Injury to a Spouse or Partner (Penal Code 273.5): Charged when there is an injury, even a bruise. Up to one year in county jail, or two, three, or four years in prison, more with priors, and a $6,000 fine.
